為深入貫徹落實中共中央和司法部關(guān)于涉外法治工作的決策部署，優(yōu)化仲裁員結(jié)構(gòu)，提高涉外案件仲裁服務(wù)能力和案件辦理質(zhì)效，現(xiàn)依據(jù)《天津仲裁委員會章程》《天津仲裁委員會仲裁員聘用辦法》的規(guī)定面向社會增聘涉外仲裁員。本次增聘仲裁員任期與第三屆天津仲裁委員會仲裁員聘期相同。

一、申請條件

符合《中華人民共和國仲裁法》第十三條規(guī)定的條件和《天津仲裁委員會仲裁員聘用辦法》第二、三條規(guī)定的要求，申請擔(dān)任本會涉外仲裁員還應(yīng)符合以下條件： 

（一）熱愛仲裁事業(yè)，公道正派，遵紀(jì)守法，未受過紀(jì)律處分，未被司法機(jī)關(guān)追究過刑事責(zé)任，未受過與從事職業(yè)相關(guān)的行政處分或者行業(yè)懲戒，未被納入失信被執(zhí)行人名單。

（二）身體健康，能夠保證一定時間從事仲裁工作，具有良好的庭審駕馭能力，年齡原則上不超過65周歲，但經(jīng)驗豐富且在所在行業(yè)享有較高聲望者可適當(dāng)放寬。

（三）具有國際商事仲裁及訴訟、國際經(jīng)濟(jì)貿(mào)易、國際投資、國際工程、知識產(chǎn)權(quán)、海事海商等專業(yè)知識和實際仲裁工作經(jīng)驗。

（四）精通英語等至少一門外國語言，并可作為工作語言使用。

（五）境外人士須系中國香港特別行政區(qū)、中國澳門特別行政區(qū)或中國臺灣地區(qū)或外國仲裁機(jī)構(gòu)的仲裁員，或者中國大陸地區(qū)仲裁機(jī)構(gòu)在冊的仲裁員，或符合仲裁法要求的其他人士。

（六）自愿遵守《天津仲裁委員會章程》、《天津仲裁委員會仲裁暫行規(guī)則》、《天津仲裁委員會仲裁員管理辦法》等相關(guān)制度。

二、申請流程

本次增聘仲裁員工作本著自主自愿、自薦與推薦相結(jié)合的原則，通過申請、審核、聘任等三個階段進(jìn)行。

（一）申請。填寫《仲裁員申請表》（點(diǎn)擊下載），按表中要求提交申請材料，確保申請材料真實、準(zhǔn)確、完整。申請材料應(yīng)當(dāng)提交電子版和紙質(zhì)版原件，并注明“應(yīng)聘仲裁員”。

（二）審核。天津仲裁委員會金融仲裁中心對申請材料的完整性進(jìn)行初審。初審?fù)ㄟ^的，提交天津仲裁委員會仲裁員初選小組審議。初選小組審議通過后，向相關(guān)部門、行業(yè)征詢意見，而后形成仲裁員初選人名單。并將該名單報請?zhí)旖蛑俨梦瘑T會審議。

（三）聘任。本會將經(jīng)審核后的擬聘仲裁員名單和資料提交本會全體會議批準(zhǔn)，并及時頒發(fā)《仲裁員聘書》。

三、申請說明

1.報名截止時間為2024年7月31日，逾期不再接收。

2.申請人有推薦人的，應(yīng)當(dāng)由推薦人親筆簽名并說明理由；有單位推薦的，應(yīng)當(dāng)加蓋單位公章并說明理由。

3.學(xué)術(shù)著作、論文或者經(jīng)典案例，請詳細(xì)載明期刊名稱、期刊號、文章名稱或者案件編號。

4.曾任法官、首席或者獨(dú)任仲裁員的申請人，請?zhí)貏e注明曾參與辦理的案件總量（包括國際案件數(shù)量）、情況、撰寫的判決書或者裁決書數(shù)量、任職的仲裁機(jī)構(gòu)名稱及任職期限等。

5.是否最終聘任為仲裁員，以天津仲裁委員會核發(fā)的仲裁員聘書為準(zhǔn)。

6.天津仲裁委員會對申請人提供的申請材料嚴(yán)格保密，如未被聘任，不再專門回復(fù)，所提供的資料予以銷毀。

Announcement on the Appointment of Foreign-related Arbitrators by Tianjin Arbitration Commission

　　In order to thoroughly implement the decisions and deployments of the Central Committee of the Communist Party of China and the Ministry of Justice on work of foreign-related rule of law, optimize the structure of arbitrators, improve the ability of foreign-related case arbitration services as well as the quality and efficiency of case handling, and in accordance with the provisions of Charter of Tianjin Arbitration Commission and Tianjin Arbitration Commission Arbitrator Appointment Measures, we hereby recruit foreign-related arbitrators from the society. The term of office for the newly appointed arbitrators is the same as arbitrators of the third Tianjin Arbitration Commission.

I.Application requirements

　　In accordance with the requirements stipulated in Article 13 of the Arbitration Law of the People's Republic of China and the requirements stipulated in Articles 2 and 3 of Tianjin Arbitration Commission Arbitrator Appointment Measures, those applying to serve as foreign-related arbitrators of this commission shall also meet the following requirements:

(I)The applicants shall be passionate about the arbitration cause, be fair and upright, law-abiding, and have not received disciplinary penalties, have not been held criminally responsible by judicial authorities, have not received administrative sanctions or profession penalties related to their occupation, and have not been included in the list of dishonest persons subject to enforcement.

(II)The applicants shall be physically healthy, guaranteeing the engagement in arbitration work for a certain period of time, with a good ability to handle arbitration proceedings. The age of the applicants should not exceed 65 years old in principle, but experienced individuals with high reputation in the profession may be appropriately relaxed.

(III)The applicants shall have professional knowledge and practical arbitration work experience in international commercial arbitration and litigation, international economic and trade, international investment, international engineering, intellectual property rights, admiralty and maritime affairs, etc.

(IV)The applicants shall be proficient in at least one foreign language, including English, and able to use it as a working language.

(V)If the applicant is not from Mainland China, the applicant shall be an arbitrator of Hong Kong Special Administrative Region of China, Macao Special Administrative Region of China or Taiwan Province of China or foreign arbitration institutions, or an arbitrator registered in arbitration institutions of Mainland China, or other persons who meet the requirements of the Arbitration Law.

(VI)The applicants shall voluntarily abide by relevant regulations such as Charter of Tianjin Arbitration Commission, Tianjin Arbitration Commission's Interim Rules for Arbitration, and Tianjin Arbitration Commission Arbitrator Appointment Measures.

II.Application procedure

　　This appointment of arbitrators is based on the principles of voluntary participation, the combination of self-recommendation and recommendation, and is carried out through three stages: application, review and appointment.

(I)Application. The applicant shall fill out the Arbitrator Application Form (click to download), submit the application materials according to the requirements in the form, and ensure that the application materials are authentic, accurate and complete. The application materials should be submitted in both electronic and paper versions, with the original documents indicating "Application for Arbitrator".

(II)Review. The Financial Arbitration Center of Tianjin Arbitration Commission will conduct a preliminary review on the completeness of the application materials. Those who pass the preliminary review shall be submitted to the preliminary selection group of arbitrators of Tianjin Arbitration Commission. After the preliminary selection group approves the review, they will seek opinions from relevant departments and industries, and then form a list of preliminary arbitrators. Then they will submit the list to the Tianjin Arbitration Commission for review.

(III) Appointment. After review, the commission will submit the list and materials of the proposed arbitrators to the plenary meeting of the commission for approval, and promptly issue the Certificate of Appointment of Arbitrators.

III.Application instructions

　　1. The application deadline is July 31, 2024, and application will not be accepted after the deadline.

2. If the applicant has a recommender, the recommender shall personally sign and explain the reasons; If recommended by an organization, the application should be stamped with the official seal of the organization and the reasons should be explained.

3. For academic works, papers or classic cases, please specify the journal name, journal number, article name or case number in details.

4. For applicants who have served as judges, chief arbitrators, or sole arbitrator, please specify the total number of cases they have participated in (including international cases), the situation, the number of judgments or awards they have written, the name of the arbitration institution they have served in and the duration of their terms.

5. The final appointment as an arbitrator shall be based on the appointment certificate issued by the Tianjin Arbitration Commission.

6.The Tianjin Arbitration Commission strictly keeps confidential the application materials provided by the applicants. If not appointed, no special responses will be given, and the materials provided will be destroyed.
